CONDITIONS
1. Definitions:

1.1 RISE Bootcamps registered office 33-35 Exchange Street, Driffield, East Yorkshire YO25 6LL

1.2. RISE means the independent business owned and operated by CONCEPT Fitness Consultancy registerd office 33-35 Exchange Street, Driffield, East Yorkshire YO25 6LL

1.3. We, Us or Our means the independent franchisee whose details can be found on the RISE web site.

1.4 Session means a group fitness session or personal training session delivered by RISE.

1.5. RISE Rules: The rules and regulations of RISE as amended from time to time.

1.6. Commitment Period: The agreed contract length the minimum term you are committing to remain a member of the RISE as stated in your contract agreement.

1.7 The RISE website is www.risebootcamps.co.uk

2. Membership:

2.1 By signing the Membership Application Form the member agrees to comply with these Terms and Conditions of Membership and the RISE Rules.

2.4 Your membership will start the day you join.

2.2 You will only be permitted to use the RISE facilities provided your membership is current and fully paid up or you have made payment arrangements acceptable to RISE.

2.3 You are entitled to group personal training sessions (subject to booking) from the start date until the commitment period end date or until payments stop. The number of sessions is determined by which membership option you chose.

3. Duration:

When you join the RISE you are agreeing to remain a member for the Commitment Period. If you choose to pay your membership fees monthly your RISE membership will continue automatically after the Commitment Period end date at the fee rate applicable to your membership type and category of membership at that date but subject to termination in accordance with paragraph 8.2. If you choose to join RISE by paying your Commitment period membership fee in advance your RISE Membership will terminate automatically on expiry of the Commitment Period.

4. Fees:

RISE will set the level of fees and will review such fees periodically. RISE reserves the right to change the level of fees from time to time but guarantees that your fees will not increase during your Commitment Period. For any changes to the monthly fee we will give you at least 30 days written notice. The following fees prevail:

4.1 Membership fee: The level of membership fees shall be determined according to the type and category of membership.

4.2 Start-Up Fee A Start-Up fee is payable as specified in your application. Your Start-Up fee goes to start-up costs.

4.3 Monthly instalments will be due on the 1st of each calendar month by Direct Debit.

4.4 Guest user fee A fee will be set by RISE from time to time in respect of guests of members who wish to use RISE.

4.5 Other Fees; All other fees and prices for the sale of goods at the RISE and any other services will be set by RISE from time to time.

5. Use of RISE Facilities:

5.1. You are entitled to use the facilities available for your category of membership package.

5.2. You may have to pay additional charges to use certain other activities at RISE. We may change these prices at any time.

5.3. Before using any equipment you must read and agree to the Commitment to Exercise. We can refuse access to the session if we consider your health maybe adversely affected by the use of the session. In such circumstances you will be referred to your GP.

5.4. RISE session may change during public holiday periods. Facilities may also close for occasional special events. Notice will be given in advance notifying customers of any changes. No refunds will be available for these periods.

5.5. We may change RISE’s opening or session times or third-party facilities may be withdrawn at any time if they are required for events tournaments exhibitions or other special activities.

5.6. A facility may close or part of it for repair/refurbishment on the grounds of health and safety or improving customer service. Sessions may also have to be cancelled due to unforeseen instructor unavailability. In the above circumstances we will use our best endeavours to:

5.6.1. Give as much notice as is reasonably practicable by communicating via social media channels in RISE.

5.6.2. Arrange for alternative facilities during a period of closure.

5.7. Your membership does not give you priority over other users or guarantee the availability of facilities.

5.8. RISE management reserve the right to change the session programme. Prior notice will be given by RISE relating to activity cancellations or the introduction of new sessions.

5.9. Promotions do not apply to existing members.

6. Membership Identification:

6.1. You must check in using the prevailing technology when accessing facilities/sessions

6.2. All members must have their photograph taken for identification purposes this will be stored on RISE database. This information will solely be used by RISE and will not be released to any third parties.

7. Suspension of Membership:

A Member may if they are unable to make use of RISE by reason of illness or injury suspend their membership for one continuous period of at least 1 month and a maximum of 3 months. 30 days written notice must be given to RISE and RISE shall have the right to request a doctor’s certificate. Your membership fee will continue as normal and any suspended months will be added onto the end of your initial contracted period. A reduced monthly fee of £19.99  will be charged by the RISE during the extended period.

8. Termination:

8.1 Termination by RISE
We may terminate this agreement in the following circumstances:

A) if you commit a serious or repeated breach of this agreement or RISE’s rules of membership and the breach if capable of remedy is not remedied within 7 days of receipt of a default notice

B) If any part of your membership fee remains unpaid 30 days after its due date for payment or

C) If you provide us with details which you know to be false when applying for membership and the false declaration would have reasonably affected our decision to grant you

If we terminate for any of these reasons we reserve the right to retain a proportion of the money paid under this agreement to cover any reasonable costs incurred.

8.2 Termination by you
You may terminate this agreement in the following circumstances:

A) Memberships cannot be cancelled prior to the agreed contract length that you have signed up for and the last payment has been made.

B) A contract may be cancelled once the final payment has been made this requires 30 days-notice in writing. Queries on cancelled memberships can only be dealt with by contacting RISE.

C) Cancelling your direct debit instruction for the payment of fees is not sufficient.

D) You may terminate this agreement on 1 calendar month’s-notice if you are unable to use RISE through serious illness or injury likely to preclude you from using RISE for a period of least 6 calendar months. (We will request reasonable evidence of your illness or injury – e.g. a doctor’s certificate).

E) You may also terminate this agreement if:

a) We permanently reduce the facilities or sessions by 50% or more

b) We change the location of RISE or

c) Facilities used close for refurbishment for a period of more than 30 days at a time.

9. RISE Rules:

9.1 RISE may amend the RISE Rules from time to time in order to ensure the health and safety of users. Temporary amendments will be displayed on the RISE web site. Permanent changes to the RISE Rules will only be made after at least 30 days-notice to members except in the case of emergency.

10. Restriction of Liability:

10.1 Subject to paragraphs 10.2 and 3 the RISE will not accept liability for any loss damage to or theft of money valuables or other personal property of members and guests. Property stored in any facility area is at the owner’s risk and no liability for loss or damage thereto will be accepted by RISE.

10.2 Our liability to compensate you for any loss or damage (in the case of loss or damage other than death or personal injury) is limited to a reasonable amount having regard to such factors as whether the damage was due to a negligent act or omission by RISE.

10.3 RISE accepts liability for damage accident death personal injury or other loss sustained by members or guests on RISE sessions to the extent caused by its negligence or the negligence of its employees and agents (during the course of their employment and agency, as appropriate) unless that failure is attributable to:

A) Your own fault

B) A third party unconnected with our provision of services under this agreement or

C) Events which neither we nor our supplier could have foreseen or forestalled even if we had taken all reasonable care.

11. Health & Safety:

Members must read all Health and Safety notices displayed on the RISE web site and comply with their recommendations.

12. Sale of RISE:

In the event of the sale or disposal of RISE to another company or to any other person we may transfer your membership to the new owner and you will continue as a member of RISE and continue to pay your membership fees provided no changes to these terms or RISE rules having a material adverse effect on your use of RISE are made by the new owner. Any such disposal will not affect your contractual or statutory rights.

13. Notices:

Notices from you to RISE must be in writing and addressed to the general manager/owner at RISE. RISE reserves the right to require evidence of posting or delivery where it has no record of receipt or the date of any notice appears inconsistent with the date of receipt. In these cases the notice will be deemed not given unless such evidence is produced. Any notice handed to RISE must be receipted. Notices from RISE to you will be posted to you at your electronic address in the membership records.

14. Junior Members and Children:

14.1. If you are 16-17 (inclusive) your parent or guardian must sign this agreement on your behalf. By signing this agreement your parent or guardian agrees to be always responsible for your behaviour and actions and to pay us any amounts that are due on your behalf.

14.2. When you reach 18 your junior membership will end and you will automatically and immediately become a full adult member and sign a copy of this agreement.

RISE RULES AND INFORMATION

We politely request all members observe the following rules.

OPENING HOURS & SESSION TIMES

The RISE opening and session times as amended from time to time are displayed online.

THE RISE WORKOUT

As a member you are entitled to the number of RISE sessions associated with the type of chosen membership subject to booking.

All sessions MUST to be pre booked in person at by phone or by using our online booking system.

You must arrive 5 minutes before your session is due to start

All sessions will start at set times and sessions times can be found displayed on our website.

We reserve the right to change our session times giving at least 14 days’ notice to Members.

There is a maximum of 40 spaces per session depending on each RISE layout.

If you need to cancel or rearrange your session please do so ASAP by using our online booking system.

You cannot book more than 4 sessions or 14 days in advance.

We reserve the right to charge £5 if you repeatedly book for sessions and then not show without cancelling at least 30 minutes before the session starts.

You must be aware that physical activity can be hazardous and there is a risk involved. You must acknowledge that you participate at your own risk and take full responsibility for your actions.

If you are on our block session or limited monthly session membership plan and you book for a session and fail to cancel at least 1 hour before the session starts then the session will be classed as taken and deducted from your remaining sessions.

FITNESS AREAS

All members must wear suitable clothing no street shoes boots or sandals are allowed in workout areas.

VALUABLES

RISE cannot accept any responsibility for the loss of personal belongings.

SAFETY AND HYGIENE

In the interest of Safety and Hygiene no crockery or glasses are allowed in the workout area. We also ask members to use a towel to wipe down any equipment after use. Entry to a RISE session is only permitted by the RISE trainer. If in a facility fire exits which are clearly marked are there in the interest of safety and members and guests must not interfere with these doors for any reason. In the event of an emergency evacuation members and guests must immediately make their way in an orderly fashion to the nearest exit.

BEHAVIOUR

If any member shall cause nuisance or annoyance to other members guests or RISE staff or misuse the RISE facilities or breach and etiquette guidelines or generally behave inappropriately RISE reserves the right to refuse admission or suspend or terminate membership. In particular abusive language threatening behaviour will not be tolerated. No photography unless permission is expressly give is allowed in any RISE session.

COMPLAINTS AND SUGGESTIONS

Please refer any comments or complaints to a member of RISE staff. Written complaints must be addressed to the RISE Trainer. Alternatively please inform head office by email: info@risefitnessbootcamps.co.uk.

GENERAL

No food or drink, alcoholic or otherwise, or illegal substances may be brought into and consumed at a RISE session.

Any breakages must be reported immediately.
